As a democratic state, the freedom to impart every opinion in public area, protection and the feeling of security of the citizen must be assured by the country. These has been clearly regulated in the forth amendment of UUD 1945 Article 28 A to 28 I. But, the fact is, in this prosperous and rich country, the feeling of justice and security are not possessed by its people. Many times, the citizens are still covered by the fear because of the intimidation from the security officers.

These can be seen from the case of shooting on two Sioyong inhabitants by the member of Brimob (Brigade Mobil – Car Brigade) in Regional Police Department of Central Sulawesi hired by PT Asean Tunggal Mandiri to secure the activity to dredge rocks from the Sioyong watershed in Village Barisan Agung.

 

The shooting was done by the member of Brimob on two Sioyong inhabitants and was caused by the construction of dam to prevent shore abrasion in Sabang Village, Damsol Sub District, Donggala District. PT Asean Tunggal Mandiri was the main contractor in the construction of the dam.

 

On April 1st 2009 this company started operating and took the rocks as their material from Sioyong Watershed in Barisan Agung Village. This activities has threaten around 1.000 hectares of productive land in three villages i.e.; Sioyong, Parisan Agung, and Karya Mukti Village. The community then started to communicate with the local government whom perceived as stakeholder.

On April 13th 2009, Technical Team from Regional Office (Balai Wilayah) of Sulawesi District III of Central Sulawesi Province conduct an appraisal in the location. The result of the appraisal conducted by Technical Team recommended to halt the dredging activity due to the great risk and impact to environment.

The inhabitants kept their act of protest on the sand dredging activity carried out by PT Asean Tunggal Mandiri; besides it damage the environment, they also found out that the company didn’t have the official permit to do the activity. To face the protest and to secure  their activity, the company hired Brimob. Until today, the company has been dredging in the river for 18 days.

Although the company has hired Brimob of Central Sulawesi Regional Police Department, it didn’t calm the fight of Sioyong inhabitants to defend their rights. About 300 Sioyong inhabitants carried out an act to block the junction to Sabang Village in order to stop the cars loaded with materials (rocks) from the irrigation of Parisan Agung Village.

The cars loaded with materials arrived in the blocked location and guarded by a team of Brimob of Central Sulawesi Police Departement with complete weapon and by a truck. Arrived in the location, the Brimob apparatus got off the truck and tried to disperse the demonstration by seizing the megaphone from the Coordinator of the demonstration.

The head of Damsol Sector Police Department met the demonstrators to negotiate. After it, he stated that the demonstration held by the inhabitants is illegal. Whereas the inhabitants via their Coordinator has submitted their letter of notification to Damsol Sector Police Department and the carbon copy (cc) to Koramil Damsol.

The inhabitants demanded that the materials loaded on the truck owned by PT ATM to be restored (Sioyong River). But via the megaphone, the Head of Sector Police Department forced the demonstrators to be dispersed and asked the coordinator of the action to go to the office of Damsol Sector Police Department. The situation was getting uncontrolled.

A riot was started, but the inhabitants were still hanging on and weren’t able to be dispersed. Due to the firm block of the inhabitants, Brimob apparatus then moved back several meters from the mass concentration.

Finally Brimob started to shoot to the air and to the inhabitants (many times, couldn’t be counted) used the long pitched combat gun (SS-1) and eyes gases, but the inhabitants didn’t do anything to fight back. They’re just stayed. Because of the shooting, two inhabitants were injured on their leg. They were; Ramang Datu Adam and Safrudin.

KPA condemned the act of Brimob of Central Sulawesi Sector Police Department who have shot two Sioyong Ponggerang inhabitants. Those shots have caused the inhabitants to be injured and now they’re being hospitalized in ICU – Undata Palu Hospital.

We also demand the Republic Indonesia Police Department not to tolerate (with any reason) to the stakeholders of the case, i.e.; 1) PT Asean Tunggal Mandiri and 2) Brimob from Central Sulawesi Police Department. Republic Indonesia Police Department must give them punishment as what they have done and demand them to be responsible for two injured inhabitants and material lost.

Thus, our Protest Letter we made, we’d like to thank every concern and cooperation.
